Where2Kid Terms of Use (EULA)

1. Acceptance of Terms

Welcome to Where2Kid. By downloading, installing, or using the Where2Kid mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Where2Kid is a mobile application that helps parents and caregivers discover kid-friendly activities, classes, camps, playgrounds, museums, parks, restaurants, and entertainment venues in their local area. The App provides information sourced from Google Places and other third-party data providers.

3. Eligibility

You must be at least 18 years of age to create an account and use the App. By using the App, you represent and warrant that you are at least 18 years old.

4. User Accounts

Some features of the App require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

5. Subscriptions and In-App Purchases

Where2Kid offers a free tier and a premium subscription ("Where2Kid Pro") with additional features. Where2Kid Pro is available as:

Monthly Plan: $3.99 per month
Yearly Plan: $29.99 per year

            Important Subscription Information:
            Payment will be charged to your Apple ID account at the confirmation of purchase.
Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.
You can manage and cancel your subscriptions by going to your Account Settings on the App Store after purchase.
Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.

        

6. Free Features

The free version of Where2Kid includes browsing activities by category and location, searching by ZIP code, viewing business details, calling or visiting business websites, saving favorite activities, and full iPhone and iPad support.

7. Pro Features

Where2Kid Pro unlocks unlimited favorite activities, activity alerts for new venues, advanced search filters, full search history, an ad-free experience, and offline access to saved activities.

8. Third-Party Content

The App displays information from third-party sources including Google Places. We do not guarantee the accuracy, completeness, or timeliness of third-party content. Business hours, phone numbers, and other details are provided "as is" from these sources.

9. Intellectual Property

All content, features, and functionality of the App, including but not limited to text, graphics, logos, and software, are the property of Where2Kid and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our prior written consent.

10. Prohibited Conduct

You agree not to:

Use the App for any unlawful purpose
Attempt to reverse engineer, decompile, or disassemble the App
Interfere with or disrupt the App's functionality or servers
Scrape, data mine, or extract data from the App by automated means
Use the App to harass, abuse, or harm others
Transmit any viruses, malware, or other harmful code through the App

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WHERE2KID SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATING TO YOUR USE OF THE APP.

13. Indemnification

You agree to indemnify and hold harmless Where2Kid and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the App or your violation of these Terms.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of any changes by posting the new Terms within the App and updating the "Last Updated" date. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

16. Apple-Specific Terms

These Terms are between you and Where2Kid only, and not with Apple Inc. ("Apple"). Apple has no obligation to furnish any maintenance or support services with respect to the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price for the App (if applicable). To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App. Apple is not responsible for addressing any claims relating to the App or your use of the App. Apple is a third-party beneficiary of these Terms and may enforce them against you.
